In this course, you need to perform Web Search Activities. For Web Search Activities, you are directed through a number of steps to locate legal sources, followed by providing answers/information relating to a set of questions. While deemed correct at the time, however, instances have occurred where the federal/state departments, agencies, courts, etc., have “updated” or “improved” their sites. This means they may have changed/reconfigured the layout of the pages/links, etc., and may have (or might at some point in the future), made adjustments to the established “steps” of the Web Search activities that involve finding the source. As such, it is difficult to ensure that the directions/instructions for the Web Search Activities maintain their validity. It is requested that you contact and inform your instructor as quickly as possible if you find yourself unable to access any of the material using the steps provided in a Web Search Activity.

Additionally, it is normally not acceptable/sufficient to merely copy and paste some provision(s) you have located as your submitted response regarding the posted web search question(s).

As virtually anyone can simply find, copy, and submit those, but generally the posed questions instruct you to actually “describe” (or similar term(s)), in your own words, what the meaning/significance of the provision(s) do/require/etc. for this allows one to better determine whether you understand, can apply, and communicate the substance of the provision(s).

The purpose of these Web Search Activities is designed to allow the student to learn how to find the applicable laws (e.g., constitutional, federal statutory, federal regulatory, state statutory, etc.), for since, as mentioned previously, these laws may frequently change (and/or differ from state to state), any person involved in a business environment should not, and should not need to, rely on some radio, television, or internet description of what a law “says,” but should be able to individually find and read the actual language itself.  (NOTE: This by no means implies, nor should it be inferred, that seeking professional legal advice is not necessary, as and when appropriate, but just that, when laws are being discussed, you need not be limited to relying on what someone else tells you it says, but should instead, be able to find that precise language yourself.)

ASSIGNMENT: WEB SEARCHES

Go to Congress.gov. (Links to an external site.) Scroll to the bottom of the page. There in the middle column under “Resources,” you will find a link to the “U.S. Code.” Click on that link, and then copy and paste the answers to the following questions:

1.       What Title and Subtitle of the U.S. Code covers aviation legislation (HINT: Aviation is a mode of transportation.)?
2.       Which part of that Title and Subtitle deal with safety concerns?
3.       Which subpart, Chapter, and Section specifically deals with airman certificate amendment, modification, suspension, and revocation?
4.       Finally, read the section (including at least some of the “Historical and Revision Notes”) to see if you can find the earliest underlying Public Law (Pub. L.) listed as a source for this provision. What year was that law enacted?

Next, go to GovInfo. (Links to an external site.) First, click on the “Category” icon. From the column on the left, click on “Regulatory Information.” Under the “Regulatory Information” heading, click on “Code of Federal Regulations.” Click on the current year. Review the titles for one containing the word “aeronautics.” Next, click on the chapter for the “Federal Aviation Administration.” Then click on the subchapter for “Procedural Rules,” followed by the part for “Investigative and Enforcement Procedures” and the Subpart for “Legal Enforcement Actions.”

(Note: If either a title dealing with “aeronautics” does not appear, or if the title does appear. But you are unable to find the section. Then use the back arrow to return to the prior page and click on the preceding year. Then begin the search process described above again).

Address the following questions/issues:

1.       Firstly, What Title of the Code of Federal Regulations deals with aeronautics?

2.       What section specifically deals with airman “Certificate action” (i.e., amending, suspending or revoking thereof)?

3.       Finally, see if you can discover the date this regulation was last amend ed and provide the Federal Register (FR) citation for that amendment.

Note: There are several sites at which you may find the U.S. Code and conduct this, or other assigned legal research. However, we are using these two sites so that you become familiarized with these more “official” government sites.
